Another lawsuit has been filed against US aircraft manufacturer Boeing through a lawyer representing survivors of victims of the 737 Max crash. In this, it is argued, among other things, that the manufacturer would violate the settlement reached with the US Department of Justice by claiming that it does not feel guilty.

The appeal was filed on February 1, 2023 in the District Court for the Northern District of Texas. In terms of content, the lawyer argues, among other things, that Boeing would violate the general settlement concluded with the DOJ.

Boeing has been ordered by U.S. District Judge Reed O’Connor to appear in court in October 2022, though the company’s settlement with the DOJ announced a clause shielding the company from further prosecution. The two sides reached an agreement in January 2021, with Boeing agreeing to pay $2.5 billion in compensation and fines to affected airlines and victims’ families.

District Judge O’Connor argued that Boeing’s settlement with the DOJ violated a law that prohibits companies from entering into settlement or stay of prosecution agreements without the knowledge of victims. As a result, the company was forced to appear in court on January 26, 2023.

The company then pleaded “not guilty”. However, according to the attorney representing the families of the victims, the company directly contradicted « the factual statement that found Boeing guilty of conspiracy to defraud the FAA. » The filing is expected to settle with the DOJ for a clause prohibiting Boeing from « opposing responsibility. »

The victims’ families also asked the judge to appoint an independent observer to monitor the original equipment manufacturer’s (OEM) safety and ethics culture. O’Connor denied that request and ruled that Boeing committed to no further crimes.
